中国对外直接投资的兴起与国际投资法的未来(英文)
【摘要】:International investment law is not based upon a multilateral legal framework comparable to theglobal regime of the WTO.WTO law covers only rudimentary aspects of foreign directinvestment,most importantly in the rules of GATS on trade in services.International investmentlaw presently rests upon a complex network of some 2,600 bilateral investment treaties(BITs),complemented by a similar volume of double taxation agreements and a number of regionaltrade agreements with special chapters on investment(for example Chapter 11 of NAFTA,theNorth American Free Trade Agreement).In view of the increasing number of investor-statedispute settlement cases that have been brought against host states in the last two decades,thelegitimacy and functionality of the current international legal investment regime has met withcriticism.
